政府被逼向人民低头

曾经闹到沸沸扬扬的地契更新退款事件终于有了结论。砂第二策划与资源管理部长拿督阿玛阿旺登雅今日宣布，政府预计将耗资2456万令吉，作为本州住宅地、农业地以及店屋的多付地契更新费退款之用﹗

在这之前人民对于退款程序模糊及出现许多不透明的处理方式。砂州人民皆对政府迟迟无法明朗化的地契更新退款事件感到担忧，纷纷透过政党和社团组织向政府表达心声和诉求。我们的首长跟部长在前已经公布将不会退款给所有受影响的地主，现在面对人民坚决的立场他们的态度已经180度的改变。

行动党的立场鲜明

行动党对于砂州地契更新和地契更新退款的问题与人民站在同一阵线，坚决捍卫人民切身的利益及权益。行动党由始至终的立场是所有到期的地契应该无条件更新99年，保障人民辛苦得来的土地不会遭到剥夺。至于地契更新退款应该公平透明的退回给所有申请退款的地主，不应该只局限某些地区或某些族群而已。

砂州地契更新费和地契更新退款的问题，经过2006，2010和2011年的砂州大选和补选，人民和行动党站在一起，透过选票向政府表达对不公平，不合理的土地政策的不满。这促使政府倍感压力，被迫修改土地政策，降低土地更新费及退还多付的地契更新费。这种种的转变是人民团结一致向政府施压的成果，也印证了人民当家做主效力。行动党很高兴许多人民一直信任行动党通过人民力量能带来改变，今天部长的宣布已经证实我们的信念是对的。

土地法典应该得以修改

土地是人民的根，在砂州现有的土地政策，人民的土地拥有权根本无法受到保障。因为政府可以透过土地法典第47条文下无条件征收人民的土地。如今，政府愿意降低土地更新费和退还多还的地契更新费给人民。那是人民与行动党共同争取所得的初步成果，为求可以享有更完善及合理的土地政策，人民应该不分种族不分背景继续与行动党为这不合理的政策斗争到底。要求砂州政府修改土地法典，保障人民土地拥有权的法定权利。让砂州各族人民能真正享有保障的土地拥有权。

政府必须公布详细的退款细节和所需的文件。土地测量局应该增设服务柜台和服务人员为退款者提供服务及从简一切多余的繁文缛节，减少地主在退款程序上面对诸多不必要的麻烦和困扰。行动党也呼吁政府在3个月里退还全部的款项而不是一拖再拖。

对于人联党，行动党呼吁他们向人民道歉因为他们在国阵里不能争取到人民的福利还一直呼吁人民不要相信行动党。他们指责行动党的同时往往忘记了他们本身的失责已经伤害到那些几十年支持他们的选民的利益。

（本报诗巫3日讯）砂民主行动党宣教主任黄培根斥责砂第二策划与资源管理部长拿督阿玛阿旺登雅的“每天12仙更新费”之说法，并说后者玩“数字游戏”避重 就轻，企图抚平民怨。 “事实上，人民要的是地契到期无条件自动更新，非每60年办理更新手续。人民更惧怕土地被政府征收。” 黄培根说，问题瘀结源自于土地法典内不合理条文，政府应该是着手修改，而不是玩数字游戏蒙骗民众。 地契应获自动更新 拿督阿玛阿旺登雅于日前向媒体表示，住宅区地契到期更新费每天仅12仙，为何人民看不开此区区之数。针对此说法，黄培根反问：“为何州政府看不开此区区之 数，而不让人民享地契自动更新权力。” “甚为讽刺的是，土地总面积相等于西马的砂州，人民难以守住寸土，而大企业却能坐拥百万公顷土地。” 黄培根重申，政府应该把焦点放在修改土地法典，包括第47条文和第48条文，让州民享有地契到期自动更新的权力。 黄培根也提到，目前，住宅区地契获更新的范围只有在拉让花园住宅区、古晋肯雅兰住宅区及美里马宝住宅区。 “其他到期的住宅区地契更新申请全未被批准，其中有的有效年限不及10年。 “当人民知道土地更新的不公平时，政府只作了局部改变以安抚民意，却没有彻底取消对人民不利的土地条文”。 黄培根谴责在职的人民代议士和国阵成员党领袖竟无重视人民意愿，无向政府大力施压以为民请愿。 他预料来屇州选举时，国阵成员党将与政府部门配合，将部份地区地契更新申请作大肆宣染作“政治广告”。　 土地虽被喻为是人民命脉，然而，黄培根说，地主却不容易以土地向银行申请借贷，因为银行不愿负起土地被征收的风险。 “不但如此，政府有权征回地契地期的土地，而地主则无法付绪司法程序反映意见，最终白白失去土地以及地上的所有不动资产包括房屋、农耕物。”

黄培根挑战人联 辩土地治安课题

（诗巫2日讯）砂州行动党宣传秘书黄培根挑战诗巫人联党领袖在来届国会选举中进行公开辩论会。辩论会的课题包括土地政策、诗巫治安问题及百物起价等。

黄培根说，只要人联党国选候选人点头答应迎战，行动党不惜自费缴还场地租金。

他是於今早在该党例常新闻发布会上，再次向诗巫人联党众领袖做出上述挑战，而无谓在各报章上“你来我往”，各自发表言论。

他指出，在这方面，作为华社最高机构的华团，本就超越政党的立场，因此它可以扮演重要的角色，协助体现民主社会主义国家的自由。

“我不明白屡次提出这项邀请时，为何执政党领袖不肯出来迎战?我只要让人民看清一切。”

黄氏表示，在来届大选中，许多民生问题显得非常重要，其中就包括土地政策、百物涨价及治安问题。
对于政府允诺今年的燃油价格不会上扬，他希望政府也要於明年做出同样的保证，他认为政府绝对有能力做到这一点。
“一旦燃油起价，就会产生连锁效应，百物就跟着起价。这种现象非常严重，最终受影响的是消费者。”

黄培根不认同只讲不做 执政党执政反对党监督
（诗巫2日讯）砂州行动党宣传秘书黄培根抨击诗巫人联党一名领袖日前指责行动党只会讲，不会做，唯有国阵成员党能在国阵里与友党商量，为地方带来发展. 对此言论，黄培根深感不同意。他说，从事政治工作者应该懂得在朝野党的不同角色。执政党执政；反对党监督。　　他是於今早在该党例常新闻发布会上如斯表示。　　

他指出，地方基本建设发展本是政府责任，因为人民缴还纳税钱，政府利用国内资源去实行，但这一切并非是反对党所能。　　他说，反对党在民主社会里是受到选民承认的党派，人民委托反对党去监督政府所实行的政策与方针，这才是反对党的责任。如果反对党不敢怒敢言，人民才会认为反对党失责。

大选个人形象勿画等号　　

已是来届南兰区行动党准候选人的他表示，其对手张泰卿的确是位好好先生。可是国会选举与个人的好形象并不能画上等号。　　 “是否他要将其进行的慈善活动与政治挂勾在一起？换句话说，如果他在来届大选中失利，是否意味着他从此不再捐款？” 　　他说，在国会里辩论的不是好好先生与捐款问题，而是针对不公的政策发表言论。

Sarawak Land Issues- the truth always hurts

The Truth always hurts

The news cutting on the left are the actual problems and difficulties that the Sarawakian are facing under the state's current Land Code(1958). Dap is the only political party that speaks out against all these unfair policies since the 90s and yet the SUPP is reluctant to recognise the issues even after its defeat in the 520 state election last year.

The people in the state sent out a very clear message to the state BN, especially the SUPP, in 2006 and yet the state government and the CM just refused to acept the verdict that the land issues are unacceptable and unjust to the people and are hampering the economic growth of the state.

Instead of accepting the challenge for a public debate with the DAP, the SUPP is politicking the whole issue and in the news released yesterday it is arranging a land issues' tour together with the officials of the Land and Survey department. Its President, George Chang is reported saying that there is no need for the people to be concerned with the land issues and that the opposition DAP is simply misleading the rakyat about the government's new land policies.

Under the new land policies, the state governmnet imposed a new tariff for the renewal premium as high as 25-40% of the land's value. The new land policies did not give the landoners any choice when it comes to government compulsory acqusiation under S48 of the Land Code.

These two have been under heavy criticism from the DAP as it is against the basic fundamental rights of the people not to give automatic uncondictional renewal to the landowners as "land" is the single most important 'tangible property' a person can own. Furthermore, it is not inducive for FDI and local investors to invest and set up production facilities in Sarawak.

I have issued a open challenge to the SUPP to a debate and the land issues is one of the key topics but so far thare is no respond form the SUPP. I wasn't not a bit surprise either as the DAP have issued open challenge to the SUPP on many occasions without success. Put it bluntly, the SUPP can't face the truth and the truth hurts-the Land Code is simply UNACCEPTABLE!

I urge all the Sarwakian to stand united in this issue-the BN must be taught to change...

避免反对党大选时造谣 人联下月土地讲解会
人联党11月初举行土地课题巡回讲解会，避免反对党来届国选再造谣，为民众解析对新土地政策的担忧。

人联党党魁拿督巴丁宜陈康南医生今日披露，为筹备来届国会选举人联党作出积极准备，包括举行土地课题讲解会，针对民生切身问题作出讲解。

此讲解会邀请土地测量局官员详细与民讲解土地课题，配合来届国选解决民众担忧。他今日在人联党常务会议后召开记者会上，作此表示。

来届国选跫声逼近，土地课题成为上届州选人联战败致命伤之一，也被视为来届国选受关注课题。政府在宣布新土地政策后受到反对党炒作，引起选民担忧。
反对党炒作
陈康南表示，人联党将在11月首个星期在3个国会选区，古晋、诗巫及美里举行土地课题讲解会，邀请土地测量局官员详细向民解释新土地更新制。
他说，古晋将是3个选区的首站进行地点，唯此项研讨会日期尚未决定。他指出，他已指示人联党宣教及组织处进行筹办此活动。

他希望通过此项讲解会让人民对新土地政策持有正确观念的了解，他说土地测量局拟定新土地收费制，他希望通过土地测量局的亲身解析，让选民更了解当中详情。
他披露，该党也将向选民讲解政府决策，让选民对政府政策存有正确观念。

Be our own masters in Sarawak, fight for our land

DAP Sarawak urge the SUPP and the state BN government to stop fooling the people again about their rights to properties ownership. The new policies announced are not only unfair, unjust and unethical but outright outrageous in every sense.

Sarawak people deserve better! We deserve to be treated as the true masters of Sarawak and truly be treated as such. We are not begging for our own rights but demand that such rights be honored by the government that was put in place by the people. As the government is by the people, it has to be of the people and for the people. Our CM and his cabinet have to understand that we are living in a democratic country and they were elected to serve the people and the state and not the other way round.

The basic rights of all Sarawakian have to start from property’s ownership as the land is our “roots”, without true ownership, how could we call ourselves the masters of Sarawak. How could we call ourselves Sarawakian if we can’t even able to defend our properties against the policies of our elected government?

We do not want any nonsense policies that treated us as fool. The voice of the people have to be heard and they are all crying out “NO” very loudly to the new land policies announced by Sarawak’s second minister of planning and resources, Datuk Sri Awang Tengah on the 26th of May 2007 in Miri.

NO! We do not want and we do not have to “buy” back our own properties after 60 years or 99 years. It is absolutely ridiculous and barbaric for the government to ask the people to buy back what they already “owned”. It is like robbing the people in broad day light.

The DAP stand is very clear and firm, that the Sarawak Land Code must give unconditional and automatic renewal to all the land leases upon their expiry. The 1958 Sarawak Land Code must be amended to protect the rights of properties ownership such as SS. 26-27(renewal and compensation) and SS. 47-48(red line).

The people of Sarawak must stand firm on this issue and must not have any disillusion that the SUPP can stand up for their rights. We must stand united and the ballot papers must be fully utilized to make our stand known. Only through political pressure would be able to see a change in the government’s policies, towards this end, the equation of check and balance is critical.

Properties without titles, what happened and who cares?

诗巫松柏西端（PINE SEDUAN)乌也路10里处，拥有二百户已居住7年的居民，至今仍没有获得地契。当地的居民有70％是土著，75％是公务员。他们以辛苦打拼赚得的血汗钱在该住宅区买屋，以为买了个安乐窝，怎知住了7年，却迟迟都无法取得地契。

彼等居住在一个毫无保障的屋檐下，真是欲哭无泪。根据了解土地局是因为该住宅区的沟渠设计不合规格，而拒绝发出地契。松柏西端住宅区的住户，曾在2004年及2005年向地方代议士，部长及土地测量局发表过有关情况，但却都没有得到任何的回应。

众居民在投诉无门的情况下，唯有向行动党求助。行动党在接获投诉后，先后两次前往该住宅区了解实况，并且和当地居民进行交流，寻求对策。在8月20日，住户代表在行动党砂州联委会宣传秘书黄培根及数位党领袖的陪同下前往土地测量局要求发放地契。

行动党希望土地局可以正视此事，早日发放地契，以安民心。毕竟，千错万错不是当地居民的错，而是相关单位行政上的偏差。所以不应该把所有的后果转嫁到无辜买家的身上。
