Who is the Supreme Judge of the country?

Don’t fall for the ploy by the opposition to create distrust and erode public confidence in the judiciary, says the de facto law minister Nazri Aziz

‘What crisis? I don’t see any’, said Nari. In Malaysia, the question as who is the Supreme Judge who sits on top of the Chief Justice of the Federal court is now being asked. The Malaysian's judicial crisis was started by Dr. M in the Tun Abbas' case and now sealed in the coffin by Nazri Aziz in the Lingam's case.

No explanation and commission can reinstate the credibility and independence of the Malaysian Judicial systm and all the thanks go to the BN. The Lingam case is even worst than the Watergate as the later only affect the election of the US president while the former was like "raping the whole Judicial system of the country in broad daylight."

Now, the Bar council went to the street in defence of the honor of the country's judicail system but i question the outcomes of the march. The BN will not even allow this issue to be debated in the Parliament as the de facto law minister said that
would violate the independence of the judiciary. But the independence of the judiciary was not violated when the CJ reported the Lingam case to the minister, what a bunch of jokers they were.

The whole episode led us asking "who is the supreme Judge of the country?" I guess we all know who he is,don't we? In the coming general election, let all of us be the real judges of the country!

Let all of us be the judges for the sake of Malaysia!

Below is a good article that many Malaysian would not even care to take a glance at. The article reveals the state of the affair of the country under the BN and the roles of the opposition in checking the abuse by the BN. In particular, the remark by Dr. M about the BN's absolute strength and "we need more opposition MPs."

The sad thing about us if we do not even bother to care about what is happening to our country, auditor-general report for 2006 released recently actually did not reach the majority of the Malaysian although the major newspapers did a wonderful job in publishing the news prominently.

What happened to us? Are we becoming the living dead? Or have the BN casted the magic spell on us to make us "dumb, deaf and blind?" The auditor-general report is only as good as the people's mentality and the opposition is only as good as the people of the country.

The famous saying "you are what you eat!" is good to describe our government, the opposition and the country. It is the people that has the final say and we, my fellow comrades, should take our little first steps to make the BN and even the opposition responsible for their actions.

"My Song"

(I sang this song at last night DAP's organised MoonC)ake festival in Paramount hotel, Sibu amist the laughter of hundreds of people.

The following "song" was composed by myself with the assistance of my party's comrades like Fong PT and Lau Hui Ung.It was not so much a song as i can't even sing in the first place, so i "borrow" the idea and quite a few phases from Namewee's Negarakuku and i have to express my thanks to him or else i would not have any idea at all as to how to compose a song.

The difference between me and Wee is that i am a politician while he is a student and it could be found in the content of Negarakuku and "My Song". Both songs revealed the present state of affair in the country although mine revealed the figures to prove the points in Negarakuku.

"My Song" main theme is the mis-managemnent of the country such as corruption and the BN's race-based policies such as the Ketuanan Melayau and the NEP and the educational policies that not only caused racial tension but also hamper the economy and development of the country.

"My Song" also tell us why we are where we are and how the chinese-based parties like the SUPP and the MCA "kow-tou" or lower themselves and the chinese community that they represented. They 3 main characters were also highlighted in the song and how they bow to the wishes of the UMNO.

"My Song" ends with the call for all the Malaysian to stand up for their own rights and not let the political parties manipulate them into believing that all is fine in the country. My earlier article "There is something rotten in the state of Malaysia" was highlighted as well. The Sarawakian dilemmas were also hightlighted as only a Sarawakian can.

I must say song writting is not an easy job and i am proud that we managed to compose "My Song" within a few hours. We would appreciate if someone with the song-writting background could come forward to refine "My Song" into a real folk song.

Thank you.

Chinese "sleeping dolls" from China caught in Sibu for engaging in the sex trade

The following news article from Sin Chew Jit Poh on the 20th of September 2007 confirmed my earlier article "Please respect and honor the good name of China" on this blog which i said "There are hundreds of these (sleeping dolls) in Sibu, Sarawak and yet the government is not doing anything about it."

Sometimes the authorities concerned simply ignore the problems although they might have knowledge and informations about the activities of these illegal "tourists". The immigration department should cooperate with the law enforcement units to check the alarming trend of the social problems brought about by these sleeping dolls.

Please respect and honor the good name of China!

I just hung up a call from a young lady who has a distinct assent of the Mainland China. It was another cone-job at work but I did not give her the time to finish off her “sales-call”.

She was worst than a hooker in actual fact, at least certain hookers would still protect the good name of their country by disguising their nationality and many do not feel that they literally cone (although they do solicit) someone into having illicit sex with them. I believe many hookers still have some shame and dignity left in them if compared to these cone women.

It is a shame that while the world looks up to the Chinese in culture, arts, literatures and many other fields, they are some of those who would smear the good name of their race and their country for their own greed and lust. Many of them operate in Malaysia and their targets are all Malaysian Chinese. News reported that many of the victims are senior citizen and those less educated sectors of the society and these have caused much outrage in the general public. Many of my friends and family members were their targets as well and they really are unimpressed by their “cousins” from China.

Malaysian immigration department and their counterparts in the police force are not doing much at all to crack down on many of these who entered as “tourist” but are actually engaged in the sex industry or selling pirating software and CD in the market. There are hundreds of these in Sibu, Sarawak and yet the government is not doing anything about it. Our DAP state assemblyman for Kidurong had in 2006 raised the issue of the Chinese “sleeping doll” in the state assembly and we have proof that there were some who entered as “foreign students” but are actually call girls who were sponsored by their rich “uncles” here. We received some heart-broken housewives who complaint that their husbands are these “uncles” and how their families were ruined by the “sleeping dolls”.

Malaysian welcomes any tourist from any country but let them know that the laws do not allow them to violate the terms and conditions of their stay in the country.

Half-way through this article, another young Chinese lady called again and I told her “please do not insult yourself and smear the name of your country, even your Chairman Mao would rise from below if he knows about what you are doing”. She hung up and I hope I will not hear another kind of this call again.

RM 200 million, where they went?

Friday September 14, 2007
Sarawak should explain extra RM200m spent, says DAP

MIRI: Sarawak DAP wants the state government to give a detailed financial breakdown on why some RM200mil in extra expenditures had been paid to construct 384 temporary bridges in Sarawak.

State DAP Information Chief David Wong said the Federal Government must also provide a satisfactory answer to this "fiasco" in Sarawak.
"We are talking about wastages amounting to RM200mil, and for the replacement of the temporary bridges. The public have a right to know what had actually happened.
"It is not good enough for an auditor-general's report to be published and then for the matter to be eventually forgotten.

"That has happened many times before. But this time, the amount is too huge to be simply forgotten. The people in Sarawak deserve some good answers," Wong said on Friday.

Auditor-General Tan Sri Ambrin Buang in his recent report to the Dewan Rakyat said that "the lack of detailed preliminary studies" was the reason why the construction costs to replace the 384 bridges out of the 570 bridges in Sarawak had risen from RM551.02mil to RM741.2mil.

Sarawak Deputy Chief Minister Tan Sri Alfred Jabu on Thursday said in Kuching that if such problems arose because of faults by the state Public Works Department (JKR) then he would rectify it, but added that many such projects are under federal jurisdiction.

Wong yesterday described Jabu's reply as "flimsy and shallow".
"Such a reply is totally unacceptable. The state government and the Federal Government must furnish a detailed breakdown on what happened to the extra RM200mil that was used up.

"To which company was the extra amount paid, for which projects, what was the initial cost, what was the increase and why was there such an increase?
"The state government cannot simply push the blame to the federal side. Both the state and federal governments must be held accountable and both are answerable to the people of Sarawak," he stressed.

Wong said Sarawak DAP wants an independent commission to be set up to investigate such misuse of funds in the state, adding that the opposition parties want to be in the commission. He further stressed that the DAP state assembly members will bring this topic into the DUN when it meets in November this year.

The people in Sarawak will be very disappointed if no proper action were taken to penalise those guilty of mismanagement or hiking up the costs of such projects, he said.

scandal after scandal-the BN ways

Wayang Kulit of the BN?

BN's Wayang-kulit (puppet show in English)?
Live bullet fired at angry ceramah crowd

Terengganu police chief Ayub Yaakob, had confirmed that one live bullet was fired by one of his officers as opposition parties PAS and PKR are claiming that the police used unprecedented violence - including firing live bullets - to disperse a ceramah in Pantai Batu Buruk, Terengganu, late last night. Two were injured in that incident and 23 arrested.

The above shows how far we have come after we have gained our Merdeka. The Malaysian government had always ruled with the iron-fist and had passed many inhumane and undemocratic Acts since Merdeka, especially after the May 13 incident in 1969. We gained our independence from the Briton but lost our freedom to our owned elected government?

Ceramah is the Malay word for the assembly of people normally associated with political events like campaign speeches, and Malaysian law made it illegal for the assembly without the police permit. Under the Malaysian law, any group of 4 people or more could be charged for illegal gathering without a valid police permit!

The human rights group and other NGOs and the opposition accused the BN of playing the “kulit Wayang” in the incident as the Police should have rejected the application for public gathering immediately so as to give the organizing committee sufficient time to respond. Under the normal circumstances, the organizing committee would presume that the police have no objection if it did not receive any news 24 hours prior to the public gathering. In any case, the police authority in a democratic country would normally not unreasonably refuse the rights of the freedom of assembly. Furthermore, water cannon and rubber bullet and crowd-dispersing tear gas would be utilized and certainly NO LIVE BULLET is to be used in a case like that.

There is something sinister in the whole episode of police brutality seen in PantaiBatuBuruk,Terengganu. There seems to be a dark hand and the opposition has every reason to suspect that the BN is the mastermind behind it.With the approaching election, the BN's propogandas would be all out to discredit the oppostion and at the same time instill fear into the hearts of peace-loving Malaysian. The SUPP had in 2001 Sarawak state election used the same tactic by putting pictures of the Indonesian riots and the terrorist attack of the 9/11 in the mainstream print media to their advantage.

Malaysian should do some hard thinking and soul-searching as to why we lost the basic human rights in our own country, more so when the government of the day was elected by our own rakyat. Like I had earlier said “ Independence means more than shouting slogans or playing lips services and patriotism is more than flag waving on the street tonight or joins the parades at the Merdeka stadium. It means liberty to search for equal opportunity and happiness, freedom to speak out for our rights, daring to take the political reform necessary and equality for every Malaysian.”

The Parliament-the Rubber Stamp of the BN

The rubber stamp in the name of “The Parliament”

The Dewan Rakyat or the Hall of the peoples in English is the highest law making body in the country and it is supposed to supervise the executive branch of the governments. Anything that is of importance to the people should be debated in the Dewan Rakyat so that the people and their representatives in the house would be able to voice their opinion and address the issues in the spirit of democracy. The executive branch should not be in control of the Dewan Rakyat or else the separation of powers in the 3 branches (legislative, executive and judicial) of the government would be in jeopardy and the people and the country would be subjected to the winch and fancy of the executive branch; which is exactly the case in Malaysia.

When Tun Mahartir was in power, the judicial branch of the government basically lost its independent when the then Lord President was dismissed. That would be the darkest day of the judicial in Malaysia and Malaysia was under labeled as a country whereby democracy is simply a phase and nothing in essence.

Our elected representatives have a duty to turn the Dewan rakyat into a true “Hall of the people” and not the rubber stamp of the BN. However, since the formation of the country, the country has been governed by the BN alone and its grip on the parliament has become stronger by the years through various means. The 2004 general election saw the BN controls more than 91% of the Dewan Rakyat and that have led to the most powerful BN at the expense of the country and the peoples. Since the PM, Abdullah came to power, the corruption index of the country has turned for the worse and the country has become less transparence as per Transparency International’s standard.

With the 91% mandate it received in 2004, the BN administration has become un-checkable and its dominant coalition partner, the UMNO, has become more authoritative in its push for the NEP and even challenging the Constitutions of the country when its leaders announced and reaffirmed that Malaysia is an Islamic state. Some UMNO leaders even challenged the Chinese to “return” to China in the parliament and used it as a butcher house when cows were slaughter in its compound to celebrate the second marriage of the PM, Abdullah.

When the PKFZ (Port Klang Free Zone) scandal was brought up by the opposition leader in the Parliament, Mr. Lim Kit Siang , the speaker of the Dewan Rakyat refused an emergency debate because “the government is looking into it”. What a joke has the BN turns the parliament into? How would the people put their trust in the parliament to protect their interest? YB or Yang Berhormat (Honorable or respected member) has been labeled by the people on the streets as Yang Bodor (idiot) or Yang Buaya (corrupted), which is not only an insult to the MPs but to the Parliament and to the country.

The country has just celebrated its 50th Merdeka, it is still in its infancy stage of development as a country. The Malaysian regardless of their race, cultural or religious background must face the truce, that this country’s future hangs not only in the balance of the division and separation of powers not only in the 3 branches of the government but also a more equable balance of political power between the BN and the opposition.

Below is reported by Malaysiakini for your reading pleasure;

A government backbencher today suggested that the Parliament is relocated to Putrajaya, the seat of the government administration.

"We need a bigger and more comfortable Parliament. We should just relocate our Parliament to Putrajaya," said Badruddin Amiruldin (BN-Jerai).

"Our Parliament is just a tall rectangular building. I understand that in the past we had no money to get a better building, but now we have plenty of money and we should build a more beautiful building in a better place."
Where the Parliament is located is not important, but we have to ensure that it is on par with the judiciary and executive," he added.

" Explaining that the Parliament was now under the tight control of executive, Wan Junaidi (photo) called for the Parliamentary Services Act to be reviewed.

He said that the Parliament needed to get out Ministry of Finance's control and has its own budget and allocations, like how it was before the Act was abolished in 1992.

There is something rotten in the state of Malaysia?

The NEP or New economy policy is actually the “Never Ending Policy” under the BN; Dr. M knows that the majority of the Malays would never be willing to forgo the special privileges that the BN started in the 70s. He also knows that any UMNO president would not be able to really abolish the NEP although officially it has ceded to exist, as that would be political suicide for him. Even an authoritarian leader like the dear Dr. who has ruled Malaysia for 22 years can’t openly defy the majority of the Malays.

Dr. M also knew that the ruling Umno and its leaders (at the expense of the non-bumi) have abused the NEP as I quote him when he talked about the Aps that was created under the NEP “這不是新經濟政策,而是濫用新經濟政策!”

We do not have to doubt his view that the BN has abused the affirmative action plan since then and majority of the bumi are unhappy that the NEP actually enriches only those well connected. We can talk to the cab drivers in KL and they would tell us that they did not benefited under the BN’s policies and that only a few BN men controlled the licenses of the taxis in KL.

However, the culture of the Malays does not allow them to question the views of those in control and they are basically very trusting people. They are the victim of the political party and their leaders because they would never be able to face the globalization like what Freidman described in his book “The world is flat.”

Dr. M had on the 15th August 2007 borrowed the phrase from Shakespeare's Hamlet 's to describe Malaysia's current state of affairs which i think is most fitting;"Something is rotten in the state of Denmark”
